The terms that apply when you use this website, request an estimate, rely on tree care information, or communicate with Wellner Arboriculture online.

These Terms and Conditions (“Terms”) govern your use of this website. They also govern any online request for information or estimates submitted to Wellner Arboriculture (“Wellner Arboriculture,” “we,” “us,” or “our”). Wellner Arboriculture is a locally owned tree care company based in Boyd, Wisconsin. We serve Eau Claire and the greater Chippewa Valley.

You agree to these Terms when you do any of the following:

  • Access or use this website
  • Submit a form
  • Request an estimate
  • Call from a website link
  • Otherwise interact with the site

If you do not agree, do not use this website.

No emergency reliance

This website and its forms are not monitored as an emergency service. If a condition creates immediate danger, stay away from the area. Then call 911, your utility provider, local emergency services, or the appropriate authority. Dangerous conditions include, but are not limited to:

  • A structure

Any references to storm cleanup, emergency work, or urgent service are subject to the following:

  • Availability
  • Weather
  • Road conditions
  • Crew safety
  • Equipment access
  • Scheduling

We do not guarantee 24-hour availability, same-day service, or a specific response time. This applies unless expressly agreed in writing.

Estimates, pricing, and scope of work

Information on this website is not a binding offer, a fixed quote, or a promise of price. Any price, range, or example on the website is general information only. Tree care pricing depends on many factors, including, but not limited to:

  • Site conditions
  • Tree size
  • Species
  • Condition
  • Access
  • Equipment needs
  • Utilities
  • Targets
  • Debris handling
  • Stump work
  • Weather
  • Crew requirements
  • Other factors

An estimate is not final until we give it to you directly for your property. Unless the written estimate states otherwise, estimates may be revised in any of these situations:

  • The scope changes.
  • Site conditions differ from what was described or visible.
  • Additional hazards are discovered.
  • Access changes.
  • Utilities or obstacles are present.
  • Weather delays work.
  • Permits or approvals are required.
  • The customer requests additional work.

Only the written estimate, invoice, work order, or signed agreement for a specific job controls the work to be performed. Sometimes these website Terms and a separate written agreement conflict. If we have signed or approved that separate agreement for a specific job, the job-specific written agreement controls for that job.

Customer authority and property responsibility

By requesting an estimate or approving work, you confirm that you have authority to authorize access to the property and the requested tree care work.

Before work begins, you are responsible for confirming the following:

  • Property ownership
  • Property lines
  • Tree ownership
  • Easements
  • Homeowner association rules
  • Landlord or tenant permissions
  • Municipal requirements
  • Neighbor permissions

Sometimes a tree or limb is near one of the areas below. In that case, you are responsible for disclosing that information and getting any needed permission, unless we agree otherwise in writing. This applies if the tree or limb is near a:

  • Property line
  • Shared boundary
  • Public right-of-way
  • Boulevard
  • Easement
  • Utility area
  • Protected area
  • Rental property
  • Association-controlled area
  • Neighboring property

Permits, utilities, and legal compliance

Unless a written agreement states otherwise, you are responsible for determining and getting any authorizations needed for the requested work. These include, but are not limited to:

  • Permits
  • Approvals
  • Association permissions
  • Municipal permissions
  • Right-of-way permissions
  • Landlord approvals
  • Neighbor approvals
  • Other authorizations needed for the requested work

We may help identify obvious issues. But unless expressly agreed in writing, we are not responsible for:

  • Legal research
  • Property-line determinations
  • Title questions
  • Permit compliance

You are responsible for identifying and disclosing underground or hidden items that may not be covered by public utility locating services. These include, but are not limited to:

  • Private electrical lines
  • Irrigation systems
  • Invisible dog fences
  • Septic systems
  • Drain tile
  • Wells
  • Propane lines
  • Landscape lighting
  • Buried cables
  • Private water lines
  • Private gas lines
  • Old foundations
  • Metal stakes
  • Concrete
  • Other underground or hidden hazards

We are not responsible for damage to undisclosed, mismarked, privately installed, hidden, or unlocatable items, except to the extent required by law.

Site access and preparation

You agree to provide safe and reasonable access to the work area. Before scheduled work, and where practical, you should move the following away from the work area:

  • Vehicles
  • Furniture
  • Toys
  • Decorations
  • Grills
  • Planters
  • Fragile items
  • Other personal property

You should also take these steps before we arrive:

  • Secure pets
  • Keep children and bystanders away
  • Unlock gates when needed
  • Disclose septic fields or soft ground
  • Tell us about anything that could affect safety, access, or equipment placement

We may need to change our plans in certain situations. This applies if any of the following occur:

  • We cannot safely or reasonably access the work area
  • The site is materially different from what was represented
  • Conditions create unacceptable risk

In any of these cases, we may take one or more of the following actions, to the fullest extent permitted by law:

  • Reschedule the work
  • Modify the scope
  • Decline the work
  • Charge for mobilization, time, or work already performed

Scheduling, weather, and right to refuse work

Many things affect tree care work. These include:

  • Weather
  • Soil conditions
  • Storms
  • Equipment availability
  • Crew safety
  • Road conditions
  • Utility issues
  • Changing hazards

We may reschedule, pause, modify, or cancel work. We may do this when we believe conditions are unsafe, impractical, or likely to cause unreasonable damage.

We reserve the right to decline any estimate request or job for any lawful reason. These reasons include, but are not limited to:

  • Unsafe conditions
  • Disputed ownership
  • Lack of permission
  • Poor access
  • Unreasonable customer demands
  • Nonpayment history
  • Harassment
  • Abusive behavior
  • Weather
  • Equipment limitations
  • Work outside our service area or capabilities

Tree work involves inherent risk

Our work involves inherent risks. This includes, but is not limited to, the following services:

  • Tree removal
  • Pruning
  • Stump grinding
  • Storm cleanup
  • Plant health care
  • Lot clearing
  • Related work

These risks may include, but are not limited to:

  • Falling limbs
  • Shifting wood
  • Ground disturbance
  • Turf damage
  • Rutting
  • Sawdust
  • Debris
  • Noise
  • Vibration
  • Stump settling
  • Root decay
  • Dust
  • Temporary access disruption
  • Unavoidable impact to nearby landscaping or surfaces

We use reasonable care and professional judgment. But we cannot guarantee that every hidden problem will be discovered. These undiscovered problems may include, but are not limited to:

  • Hidden defects
  • Underground conflicts
  • Internal decay pockets
  • Root problems
  • Pest issues
  • Disease
  • Structural weakness
  • Future failure

A risk assessment, pruning, treatment, or cleanup reduces certain risks. But it does not eliminate all risk. It also does not guarantee that a tree will remain safe, healthy, stable, or alive.

Plant health care and tree outcomes

Our recommendations are based on the information we have at the time. This includes:

  • Visible conditions
  • Available information
  • Professional judgment
  • Accepted practices at the time

This applies to plant health care, insect or disease recommendations, tree preservation, pruning, watering guidance, and planting advice.

How a tree responds depends on many factors outside our control, including:

  • Weather
  • Soil
  • Pests
  • Disease pressure
  • Watering
  • Aftercare
  • Prior damage
  • Species
  • Age
  • Construction impacts
  • Root conditions
  • Other factors outside our control

Unless we give you a specific written warranty, we do not guarantee that any treatment, pruning, planting, or recommendation will:

  • Cure a tree
  • Prevent decline
  • Prevent future failure
  • Stop all pests or disease
  • Keep a tree alive

Debris, logs, chips, and stump work

The following tasks are included only if the written estimate or agreement says so:

  • Debris hauling
  • Brush removal
  • Wood removal
  • Firewood cutting
  • Chip removal
  • Chip spreading
  • Stump grinding
  • Root grinding
  • Soil replacement
  • Seeding
  • Lawn repair
  • Final grading

If the estimate does not specifically include a task, assume it is not included.

Unless removal is included, the following materials may remain on site:

  • Wood chips
  • Logs
  • Sawdust
  • Stump grindings
  • Root material

Stump grinding may leave underground roots that decay over time. As they decay, they can cause settling, mushrooms, or changes in the surrounding soil.

Payments, invoices, and collection

Payment is due according to the written estimate, invoice, or agreement. If no separate payment date is stated, payment is due when invoiced or when the work is completed.

You agree to pay for:

  • Approved work
  • Approved changes
  • Materials
  • Mobilization
  • Completed portions of work
  • Any additional services requested or authorized

To the fullest extent permitted by law, overdue balances may be subject to:

  • Late fees
  • Interest
  • Collection costs
  • Lien rights
  • Court costs
  • Reasonable attorney fees

We may pause or decline future work for unpaid accounts.

Cancellations and changes

If you need to cancel, postpone, or change scheduled work, please contact us as soon as possible. Depending on timing and circumstances, you may be responsible for costs already incurred. These costs may include, but are not limited to:

  • Mobilization
  • Labor
  • Materials
  • Permits
  • Subcontractor charges
  • Equipment reservations
  • Work already performed

The following changes may require a revised estimate or additional charges:

  • Scope
  • Schedule
  • Access
  • Cleanup
  • Debris handling
  • Stump work
  • Additional trees

Communications and consent to contact

You give us contact information in several ways. This includes submitting a form, calling, emailing, texting, or otherwise providing your contact information. By doing so, you authorize us to contact you about:

  • Your inquiry
  • An estimate
  • Scheduled work
  • An invoice
  • A follow-up
  • A safety issue
  • A related service matter

We may contact you by any of these methods:

  • Phone
  • Voicemail
  • Text message
  • Email
  • Other reasonable method

Message and data rates may apply.

You agree that the information you give us will be accurate. You also agree not to submit someone else’s contact information without their permission.

Photos, reviews, and submitted content

You may send us content such as photos, videos, reviews, testimonials, comments, or other material. If you do, you grant us permission to use that content for our lawful business purposes. These purposes include, but are not limited to:

  • Service

  • Quality control

This permission applies unless you tell us otherwise in writing and we agree.

We may take photos of our own for documentation, insurance, training, quality control, and marketing. These include:

We try to avoid publishing personal information, house numbers, license plates, or identifiable people without permission.

Website use rules
